Hospital Settles for Nearly $6.5 Million in Child’s Brain Injury Birth

LOS ANGELES (CNA) – A judge has approved a settlement of nearly $6.5 million on behalf of a 20-month-old girl who was born with a severe brain injury at Cedars-Sinai Medical Center in 2023 after the doctor in charge allegedly left the handling of the difficult delivery up to two residents instead of supervising the entire procedure herself.

Los Angeles Superior Court Judge Tony L. Richardson gave his nod to the $6.47 accord Friday after hearing testimony from the child’s mother, Shoshona Primack, who along with her husband, Adam Primack, sued the hospital in August 2023.

The net amount the child will receive after attorneys’ fees and other expenses are deducted is about $3.47 million, according to the plaintiffs’ attorneys’ court papers.

Shoshona Primack’s gynecologist had allegedly promised to be present when the plaintiff’s child was born, but instead gave directions to two residents and did not arrive herself until nine minutes after the child was delivered with a vacuum limp and not breathing, according to the suit.

The girl will incur medical expenses for an indefinite time, the suit states.

In their court papers, hospital attorneys denied any liability on their client’s part and said any damages suffered by the plaintiffs during the girl’s Sept. 7, 2023, birth were due to the Primack’s own negligence and that their claims belong in the workers’ compensation arena.
