Parents Sue Fitness Club Daycare After Video Shows Worker Throwing Toddler

A Los Angeles-area family has filed a lawsuit against the Bay Club in El Segundo, California, after surveillance footage appeared to show a daycare worker throwing their 23-month-old son over her head, resulting in serious injuries. The incident happened on March 17, 2025, and is now at the center of ongoing litigation, according to a report by The New York Post.

According to the lawsuit, the boy—identified as C.K. in court documents—suffered a traumatic brain injury, concussion, facial abrasions, and later developed hearing loss after falling onto a hardwood floor while in the care of a Bay Club employee. The surveillance video, reviewed by multiple outlets, appears to show the worker swinging C.K. by his arms and lifting him above her head before he fell from about six feet and the employee landed on top of him.

Court documents allege that the Bay Club initially told the parents the child had only fallen from about one and a half feet and that the worker had simply lost balance while squatting. However, the lawsuit claims the surveillance footage contradicts this account, showing a much higher fall and accusing the Bay Club of giving “intentionally false and misleading” information. The boy’s father had dropped him off at the Clubhouse before going to the nearby Manhattan Country Club, about a mile away, which the lawsuit argues means the Bay Club should have been licensed under state childcare rules.

The family’s attorney, Ryan Saba, said: “The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable. The day care facility should have the highest amount of care for the children, and if a child gets sick or injured, they should notify the parents with transparency and urgency.”

The lawsuit seeks damages for negligence, battery, fraud, and emotional distress, with the amount to be determined by a jury. The Bay Club has stated it cannot comment on ongoing litigation but said, “the safety of our members, team members, and the families we serve is our highest priority.”

As the legal process continues, the family alleges their son still suffers from symptoms related to the injury more than a year later. The outcome of the lawsuit and any changes to club or daycare licensing requirements remain pending.
