Shocking Twist in Water Bottle Death of 12-Year-Old

A surprising development has emerged in the case of Khimberly Zavaleta Chuquipa, a 12-year-old student from Reseda Charter High School, who died after being struck with a metal water bottle during a bullying incident.

On Tuesday, the Los Angeles County Medical Examiner announced that Khimberly’s death was due to natural causes, not homicide. The medical examiner identified a cerebral arteriovenous malformation (AVM) as the cause of death, a rare condition present at birth that involves fragile blood vessels in the brain, which can rupture unexpectedly.

Khimberly was struck in the head on February 17 and died days later after emergency brain surgery. Her family had filed a lawsuit against the Los Angeles Unified School District, alleging negligence in addressing bullying. In April, the Los Angeles Police Department arrested a juvenile suspect on suspicion of murder, but the medical examiner’s ruling now challenges the basis of that arrest.

According to the medical examiner, the AVM caused a “spontaneous rupture” of blood vessels in Khimberly’s brain. Dr. Odey Ukpo, chief medical examiner, explained that such ruptures lead to catastrophic bleeding quickly and are life-threatening. The ruling does not link the water bottle incident directly to the brain bleed.

The family’s attorney, Robert Glassman, criticized the medical examiner’s conclusion, arguing that it overlooks the sequence of events leading to Khimberly’s death. He stated that Khimberly was a healthy child before the incident and that the civil case against the school district remains valid, focusing on the district’s failure to protect Khimberly from bullying.

A spokesperson for the Los Angeles Unified School District expressed condolences but declined to comment on the ongoing litigation. The Los Angeles Police Department has not provided updates on the investigation.

This case echoes a similar situation in 2024, when another LAUSD student, Shaylee Mejia, died after a campus fight. Her death was eventually ruled an accident due to unrelated injuries.
