A San Bernardino homeowner, Jesus Serna, claims a county sheriff’s deputy entered his backyard without a warrant and fatally shot his dog, Daisy, on May 4.
The incident has left the family shaken and raised questions about the deputies’ presence at the home.
According to ABC7, Serna’s attorney, Tim Scott, criticized the deputies’ actions, suggesting they may have violated constitutional protections. Scott stated, “It appears based on everything we know that they just let themselves into a backyard with no warrant, no emergency.” The family is still seeking answers as to why the deputies were there in the first place.
The San Bernardino County Sheriff’s Department confirmed that the deputy did not have a search warrant. They explained that the deputy was conducting an administrative investigation after a stolen vehicle was reported at the address. However, the vehicle was unrelated to Serna’s property.
Surveillance footage shows the deputy entering the yard and shooting Daisy as she approached. The incident has left Serna’s children scared to be at home, fearing another unexpected visit. Serna, who was not home during the incident, expressed his outrage, saying, “She was just defending her home.”
KARK reported that Serna’s other dog, Raven, was taken to an animal shelter after the incident. Serna had to pay nearly $250 to retrieve her.
The deputy involved remains on duty pending the outcome of an internal investigation. The sheriff’s department is reviewing body camera and surveillance footage to determine the circumstances surrounding the shooting.
