LOS ANGELES (CNS) – A settlement has been reached in a lawsuit brought against Los Angeles Unified on behalf of a 13-year-old special needs student who allegedly was left with a brain injury after two attacks by other students at Arlington Heights Elementary School in 2022.
An attorney for the boy filed court papers on Monday with Los Angeles Superior Court Judge Bradley S. Phillips notifying the judge of an “unconditional” resolution of the case. No terms were divulged.
According to the suit, the boy was playing soccer during recess with other children on March 11, 2022, when he was hurt. In the first attack, a fellow student rammed his shoulder into the plaintiff, causing him to fall against a steel container box. In the second, a student kicked him in one leg, according to the suit, which further alleges the administration did not contact the plaintiff’s father either time.
“Plaintiff’s father only became aware of the attacks because of plaintiff’s complaints when he came home from school,” the suit stated.
The boy suffered a brain injury that has caused “life-altering consequences for development, mental processing, cognition, emotional stability, future earning capacity, sociability and anxiety,” the suit alleged.
