LOS ANGELES (CNS) – A lawsuit was filed against Los Angeles Unified on behalf of a girl who alleges the administration failed to protect her when she was racially harassed by another student at her Los Feliz middle school and also threatened to rape her.
The girl, now 14, is identified only as Q.F. in the Los Angeles Superior Court lawsuit that alleges negligence, intentional infliction of emotional distress, civil rights violations and a violation of the state Education Code. The suit seeks unspecified damages.
An LAUSD representative did not immediately reply to a request for comment on the suit brought Thursday.
Q.F. was enrolled at Thomas Starr King Middle School. The suit does not state her race.
After the other student allegedly racially harassed the plaintiff the first time and she received no help from the administration, he repeated the threat last May and also threatened to rape her, the suit alleges.
Q.F. reported the second alleged taunt, but the other pupil was not reprimanded and is still a threat to the plaintiff, the suit states.
As a minor, Q.F. was dependent on the supervision of the LAUSD’s employees to provide for a safe learning environment at school, the suit states.
“The school has not done anything to ensure that students are properly supervised and have not even separated the plaintiff from her abuser,” the suit states.
As a result, the girl has suffered severe emotional distress, including self-harm ideation and academic struggles that require therapy, the suit states.
