SCOTUS Sides With Trump On Immigration Cases

The Supreme Court has sided with President Donald Trump on two significant immigration cases, allowing the administration to reinstate a policy that turns away asylum seekers before they enter the U.S. The policy, originally started under former President Obama, received approval from the high court on Thursday (June 25).

In a separate ruling, the Supreme Court also supported the Trump administration’s decision to end Temporary Protected Status (TPS) for Haitians and Syrians. This decision could affect approximately 350,000 Haitians and 6,000 Syrians, potentially forcing them to leave the United States. The TPS program, established by the Immigration and Nationality Act, provides work authorization and protection from deportation for individuals from countries deemed unsafe due to armed conflict, natural disasters, or other extraordinary conditions.

The termination of TPS for Haiti and Syria was announced by then-Secretary of Homeland Security Kristi Noem, who argued that conditions in these countries had improved and that continuing TPS was not in the national interest. However, lower courts had previously blocked the Trump administration’s efforts, citing procedural issues and potential racial bias in the decision-making process.

Critics, including immigrant advocates and some business groups, argue that TPS holders are vital to the U.S. labor force, especially in healthcare and caregiving sectors. They also express concerns that the Supreme Court’s decision could jeopardize the status of TPS holders from other countries.

The Trump administration maintains that courts should not interfere with DHS decisions regarding TPS designations, as Congress intended these statuses to be temporary. The Supreme Court’s decision is expected to have wide-ranging implications for the future of TPS and immigration policy in the U.S.
