Orange County District Attorney Todd Spitzer and Superior Court Judge Shawn Nelson may face a trial in San Diego next month over allegations of retaliating against whistleblowers. The case, set for a jury trial on May 2, will determine if Spitzer retaliated against women in the prosecutor’s office for reporting sexual harassment by former senior assistant district attorney Gary LoGalbo.
Tracy Miller, a former senior assistant district attorney, claims she was forced out of her position after reporting LoGalbo’s misconduct. According to OrangeCountyLawyers.com, LoGalbo, who was found dead at 57, was reportedly the best man at Spitzer’s wedding. Miller’s attorney, John Barnett, stated, “The highest-ranking law enforcement officials in the county failed to protect young prosecutors from a predator.”
The lawsuit against the County of Orange alleges that Spitzer created a hostile work environment and retaliated against those who reported harassment. Spitzer also allegedly gave LoGalbo preferential treatment despite knowing his history of harassment.
An investigation commissioned by the county found Spitzer “not credible” in his denial of retaliation. However, Spitzer maintains that the allegations are false and politically motivated as he seeks re-election. According to New Santa Ana, an ethics complaint has been filed against Spitzer for allegedly violating his ethical duties during the scandal. The trial’s outcome could impact Spitzer’s political future, with his current term ending on January 4, 2027.
