Man Sues Carnival Cruise Over Hot Pool Deck Burns

A Florida man, Jorge Luis Alverio Nunez, has filed a $5 million lawsuit against Carnival Cruise Line after allegedly suffering severe second-degree burns on his feet from a hot pool deck. The incident occurred aboard the Carnival Magic in late May 2025, when Nunez walked barefoot on the Lido Deck. The lawsuit, filed in the Southern District of Florida, claims Carnival failed to warn passengers about the dangerously hot deck surface.

According to the complaint, Nunez sustained burns after taking approximately 20 steps from the pool to his lounge chair. The lawsuit asserts that the deck’s temperature was unexpectedly high, causing severe burns within seconds. Nunez alleges that Carnival was aware of the risks, citing at least 25 similar incidents and 42 complaints from passengers between 2019 and 2025. The deck material, API Syntheteak, was reportedly known to reach unsafe temperatures, with warnings from the manufacturer dating back to 2014.

Carnival Cruise Line has not commented on the pending litigation. The lawsuit seeks compensatory and punitive damages, claiming the company’s actions were “willful, wanton, and displayed a reckless disregard for safety.” Nunez’s injuries have led to significant medical expenses, mental anguish, and loss of earnings. The case highlights ongoing concerns about passenger safety on cruise ships and the responsibility of cruise lines to maintain safe environments.
