Judge to Decide on DA Hochman’s Role in Menendez Case

Attorneys for Erik and Lyle Menendez are seeking to remove Los Angeles District Attorney Nathan Hochman from their resentencing case. The brothers, convicted of killing their parents in 1989, argue that Hochman’s bias and alleged mistreatment prevent a fair hearing. Hochman opposes their resentencing, stating the brothers have not fully admitted to their crimes. He also dismisses new evidence of abuse as irrelevant, claiming the murders were motivated by greed.

The defense, led by attorney Mark Geragos, has accused Hochman of violating Marsy’s Law by showing a crime scene photo during a hearing, which distressed a family member. They also point to Hochman’s demotion of two prosecutors who supported the brothers’ resentencing as evidence of bias. These prosecutors have since filed lawsuits against Hochman.

The California Attorney General, Rob Bonta, supports Hochman, stating the defense has not shown a conflict of interest. Recusal requests like this are rarely granted, as noted by legal experts. The final hearing is scheduled for June 13, where the decision on Hochman’s involvement and potential clemency for the brothers will be addressed.

The Hollywood Reporter provides detailed coverage of the case, highlighting the defense’s concerns about fairness. The Guardian outlines the legal arguments and the support from the state attorney general. ABC News discusses the rarity of such recusal requests and the upcoming clemency decision by Governor Gavin Newsom.
