President Donald Trump criticized former President Joe Biden on Tuesday (May 26) after Biden filed a lawsuit against the Department of Justice (DOJ) to prevent the release of audio recordings and transcripts. These materials are linked to a special counsel investigation into Biden’s handling of classified documents. Trump expressed his disapproval on Truth Social, calling Biden “a Crooked Politician.”
Biden’s lawsuit, filed in Washington, D.C.’s federal court, aims to stop the DOJ from releasing recordings and transcripts of his conversations with ghostwriter Mark Zwonitzer. These materials were obtained during Special Counsel Robert Hur‘s 2023 investigation into Biden’s handling of classified documents. The DOJ plans to release them to the U.S. House Judiciary Committee and the Heritage Foundation on June 15.
Biden’s legal team argues that releasing the materials would violate his privacy. Biden’s attorney, Amy Jeffress, stated that the DOJ reversed its previous position that the materials were exempt from disclosure. The lawsuit emphasizes the personal nature of the conversations, which were intended for Biden’s memoir, Promise Me, Dad.
The Heritage Foundation, which sued for access under the Freedom of Information Act, claims the materials could show mishandling of classified information. Biden’s spokesperson, TJ Ducklo, argued that the DOJ’s actions are politically motivated and not about transparency.
Politico reported that the DOJ initially withheld the materials, citing privacy concerns. However, the Trump administration recently decided to release them. Biden maintains that he never shared classified information with Zwonitzer.
The court has allowed Biden to argue against the release to the Heritage Foundation, but not against the House Judiciary Committee’s request.
