DA Hochman Updates on Menendez Brothers’ Resentencing

Los Angeles County District Attorney Nathan Hochman provided an update on the Menendez brothers’ case on Monday, focusing on their resentencing request. The Menendez brothers, Lyle and Erik, are serving life sentences without parole for the 1989 murders of their parents, Jose and Kitty Menendez. They have filed a habeas corpus petition, a clemency plea with California Governor Gavin Newsom, and a resentencing request.

Hochman has recommended that the court reject the habeas corpus petition, which is based on new evidence of alleged sexual abuse by their father, Jose Menendez. He argued that the new evidence, including a letter from Erik Menendez and a declaration from Roy Rossello, a former member of the pop group Menudo, is not credible or admissible. Hochman stated, “Sexual abuse in this situation may have been a motivation for Erik and Lyle to do what they did, but it does not constitute self-defense” (CNN).

The brothers’ resentencing request, which could make them eligible for parole, is set for a hearing on March 20 and 21. Hochman has not yet announced his decision on this matter but is expected to do so soon. The resentencing decision will consider factors such as the brothers’ rehabilitation efforts during their time in prison (WBALTV).

The Menendez brothers’ case has gained renewed attention due to new evidence and social media support. However, Hochman’s stance has been met with criticism from the brothers’ family and supporters, who argue that the abuse they suffered should be considered in their defense (ABC News).
