Alex Murdaugh Could Face Death Penalty In Retrial

South Carolina Attorney General Alan Wilson announced Friday (May 15) that prosecutors could seek the death penalty against Alex Murdaugh if he is found guilty again at a new trial. This follows the South Carolina Supreme Court’s decision to overturn Murdaugh’s 2023 murder convictions. The court cited improper jury influence by former court clerk Becky Hill as the reason for the decision.

Wilson stated, “In light of the Supreme Court’s decision, we’re back to square one on this case, and that means all our legal options are on the table, including the death penalty.” The Supreme Court’s unanimous decision to vacate Murdaugh’s convictions stems from Hill’s alleged attempts to sway the jury during the trial. Hill reportedly advised jurors to be skeptical of the defense’s evidence and to focus on Murdaugh’s demeanor.

In December 2025, Hill pleaded guilty to charges of obstruction of justice, perjury, and misconduct in office. She admitted to showing sealed court exhibits to a reporter and promoting a book she wrote about the trial. Hill was sentenced to three years of probation.

Murdaugh, who was initially sentenced to life in prison without parole for the murders of his wife, Maggie, and son, Paul, has always maintained his innocence. His defense team has welcomed the court’s decision and expressed readiness for a new trial. They have stated that Murdaugh will not accept a plea deal under any circumstances.

The retrial is expected to be a high-profile case, as Murdaugh’s previous trial garnered significant media attention. Prosecutors accused him of committing the murders to divert attention from his financial crimes. Murdaugh has already pleaded guilty to numerous state and federal financial crimes, for which he is serving concurrent prison sentences.
