The hearing will address a motion from Robinson’s defense team seeking contempt against prosecutor Christopher Ballard. The defense accuses Ballard of violating a pretrial publicity order by discussing his opinions on Robinson’s guilt with the media.
Robinson, 23, is charged with fatally shooting Kirk in September 2025 at Utah Valley University in Orem. Prosecutors have announced their intention to seek the death penalty. The defense argues that Ballard’s media comments about a bullet fragment found during the autopsy breached the court’s order limiting public statements about the case. They are requesting that the court prevent prosecutors from pursuing the death penalty if Ballard is found in contempt.
Ballard, a spokesperson for the Utah County Attorney’s Office, maintains that his comments were intended to clarify misinformation and were within legal bounds. He testified that the remarks aimed to address media inquiries generated by the defense’s public filings, which he claims misrepresented the ballistics report.
The case has drawn significant media attention, with Robinson’s attorneys expressing concerns about potential impacts on their client’s right to a fair trial. The next significant hearing is set for July 6, when prosecutors must demonstrate they have sufficient evidence to proceed to trial.
Judge Tony Graf will rule on the contempt motion and other matters, including the admissibility of certain evidence, on Tuesday.
