Trump Expects SCOTUS to Rule Against Him on Citizenship

President Donald Trump anticipates the Supreme Court will rule against his executive order aimed at ending birthright citizenship, a decision expected this summer. The executive order, signed on January 20, 2025, sought to deny U.S. citizenship to children born in the country to parents who are in the U.S. illegally or temporarily. This move has sparked significant legal challenges, with opponents arguing it violates the 14th Amendment, which grants automatic citizenship to anyone born in the U.S.

The Supreme Court heard oral arguments in _Trump v. Barbara_ on April 1, where various groups, including the ACLU and the Legal Defense Fund, presented their case against the executive order. According to ACLU New Hampshire, the order has been blocked by federal courts, citing its unconstitutionality and violation of longstanding legal precedents.

The executive order challenges the principle of _jus soli_, or right of the soil, which has been a cornerstone of U.S. citizenship law since the 14th Amendment’s ratification in 1868. The Supreme Court’s 1898 decision in _United States v. Wong Kim Ark_ affirmed that children born in the U.S. to immigrant parents are entitled to citizenship. The current case has drawn attention to this precedent, with SCOTUSblog reporting skepticism from several justices regarding the administration’s arguments.

Trump has stated that a ruling against him would be a “great disservice” to the country. However, legal experts and advocates argue that birthright citizenship is deeply rooted in American law and values. The Supreme Court’s decision, expected by late June or early July, will have significant implications for the future of citizenship in the United States.
