Palisades Fire Victims Sue California’s FAIR Plan

Victims of the Palisades Fire in Los Angeles have filed a lawsuit against the California FAIR Plan, the state’s insurer of last resort, alleging mishandling of claims. The lawsuit, led by Scott and Lissette Jungwirth, accuses the FAIR Plan of delaying payments and failing to provide necessary documents to repair their fire-damaged home. The Jungwirths claim their home was contaminated with hazardous materials like lead and cyanide, requiring extensive repairs. They have been forced to live in temporary accommodations due to the damage.

The lawsuit, filed in Los Angeles County Superior Court, seeks a court order to compel the FAIR Plan to release claims documents. It also highlights broader issues with the FAIR Plan, accusing it of bad faith and breach of contract. The FAIR Plan, operated by California’s licensed home insurers, has faced criticism for its handling of smoke damage claims from the January wildfires. According to the Los Angeles Times, the plan has been accused of refusing to properly investigate and pay for necessary cleanups.

The lawsuit comes amid a broader legal battle involving the FAIR Plan and Southern California Edison, which is also facing lawsuits for its alleged role in causing the fires. The FAIR Plan has been under financial strain, having assessed its member insurers $1 billion to cover claims from the fires. Insurers are now seeking to surcharge homeowners across California to recoup these costs, as reported by the Los Angeles Times.

The legal challenges against the FAIR Plan and other parties involved in the wildfires are expected to continue, with additional lawsuits anticipated in the coming months.
